## What a sponsor sale adds at closing

On a resale you pay your own closing costs. On a sponsor sale the offering plan customarily moves the seller’s transfer taxes and the sponsor’s attorney fee onto you as well. Those terms are negotiable, and on a unit that has been sitting they are often the part of the deal a sponsor will move on before the asking price.

## What a sponsor sale costs that a resale does not

A new development condo is sold by the sponsor under an offering plan filed with the New York State Attorney General, and that plan decides who pays what at closing. Most plans move the New York State and New York City transfer taxes onto the buyer. New York State charges $2 for every $500 of consideration and is the seller's obligation by default; New York City charges 1.425 percent on residential sales above $500,000, with a further $1.25 per $500 once the price reaches $3 million. Shifting those onto the buyer does more than add them to the bill, because what the buyer pays on the sponsor's behalf is itself treated as consideration and taxed again. Add the sponsor's attorney fee and a working capital contribution of a month or two of common charges. Every one of those is a term in a contract rather than a rule, which means every one is negotiable, and on a residence that has been sitting they are usually the first thing a sponsor will concede.

## Common questions about buying new construction in NYC


### Are there any new construction condos for sale in NYC?
+
965 right now, across 295 developments, at a median asking price of $1.8M. That is the condos a listing broker has entered on the REBNY Residential Listing Service as new development or sponsor inventory, so the count moves as buildings launch and close out. It is smaller than the number of units under construction in the city, because a building that has not released its first residences has nothing to list yet.


### Who pays the transfer taxes on a new development condo?
+
The offering plan decides, and most plans put them on the buyer. New York State charges $2 per $500 of price and is the seller's obligation by default; New York City charges 1.425 percent above $500,000, plus $1.25 per $500 once the price reaches $3 million. The part buyers miss is that when the contract shifts those taxes, what the buyer pays on the sponsor's behalf counts as consideration and is taxed in turn, so the bill runs higher than the headline rates applied to the purchase price. It is a contract term rather than a law, which is why it is worth negotiating before you sign.


### What is the mansion tax on a new construction condo?
+
A buyer-paid New York State tax starting at 1 percent of the price at $1 million and rising in steps to 3.9 percent above $25 million. It applies to the whole price rather than the slice above each threshold, so crossing a threshold by a dollar costs the full step. At a median of $1.8M most residences on this page clear at least the first one. The mansion tax calculator prices a specific purchase, and it is separate from the transfer taxes above.


### Do I need to register my broker before visiting a sales office?

Yes, and this is the one thing that cannot be fixed afterwards. On a new development the sponsor pays the buyer's broker, and sponsors will generally not recognise a broker introduced after the buyer's first visit. Walk into the sales office alone and the agent there represents the sponsor, no one represents you, and there is no buyer-side commission for anyone to share with you. Register before you tour or contact the sales office and nothing about your offer changes, except that you have your own representation and an eligible purchase earns the Buyer Commission Share.


### Where is most of New York&#x27;s new construction?
+
Manhattan by a wide margin, and within Manhattan it clusters where the towers are: the West 57th Street corridor, Hudson Yards, Tribeca, the Financial District and the Upper East Side. Brooklyn has a substantial and growing supply concentrated in Williamsburg, Downtown Brooklyn and along the waterfront. Queens is smaller and mostly Long Island City. The borough, neighborhood and ZIP lists below are built from live counts, so they move with the market rather than with anyone's opinion.


### What is an offering plan and what should I read in it?
+
The document the sponsor files with the New York State Attorney General setting out the building and the terms of sale. Four parts decide what a purchase actually costs. The closing-cost schedule says which taxes and fees the buyer has been assigned. The projected budget sets the first year of common charges, which is a projection rather than a promise. The description of property states what is being delivered, as against what a rendering shows. And the sponsor's obligations set out what happens if the building is late. Your attorney reads all of it before you sign, and this is not a step to compress.


### Do new construction condos cost more to run each month?
+
Usually less at first and more later, which is the trap. A new building's first-year common charges come from a projected budget in the offering plan, and projections run optimistic on staffing, insurance and energy in a way the second year corrects. A new building also has no repair history and no reserve accumulated from years of contributions. Ask what the sponsor projected, ask what comparable buildings of the same size and amenity level actually charge, and treat the difference as the increase to expect rather than a saving you have found.


### What does a temporary certificate of occupancy mean for my purchase?
+
A TCO lets residents move in before the building is finished, and closings on new construction routinely happen under one. It is normal rather than alarming, but it has consequences. Some lenders will not fund against a TCO, or will fund on different terms, so confirm financing against the actual certificate rather than assuming. And work continues after you move in, so the amenity floors and outdoor space may not be finished when you are.


### Is there a Buyer Commission Share on a new development?
+
On a purchase at the $1.8M median here it works out to an estimated $27,000, credited to you at closing. Sponsors pay buyer-broker compensation on almost every new development, which is why the share is largest on exactly these purchases. Where we are compensated, we share half of what we actually receive with you as Savings at Closing. It is not a discount on the asking price, it does not come out of your deposit, and it does not weaken your offer. What it requires is a signed buyer agreement and that we are the broker who introduces you to the building.
